As Rossi holds the contract valid do IH have no where else to go?

    As Rossi holds the contract valid do IH have no where else to go?


    As IH seem to have realised the motion to dismiss appears to have failed, they now wish to go back to the offer Rossi made to them almost a year ago but the concept of the time value of an offer seems to have escaped their notice.


    Now the contract terms on Rossi are complete it makes far more economic sense for Rossi to hold the contract fulfilled on his part.


    Hence Rossi can as he has done with the court case demand the $89 million due for proof of IP effectiveness, IH have rights to his old IP nothing new, if they pay up straight away. And as he has done, Rossi has removed the IH exclusive territorial license due to repudiation of those contract terms by inaction.


    And the no compete clause means IH cannot even use their other IP.


    So where now for IH?

  • It's a moot point as to whether Rossi has the right to "remove" IH's license unilaterally in that fashion.
    Was there any time limit for action specified in the contract? Did it specify the range of possibilities if there was a dispute over payment? Over IP?


    Oh well - presumably Rossi's lawyers approved his action, or did not disapprove it.

  • Walker's liebomb fabrication factory most be automated by one of Rossi's robots - it is working overtime with some real juicy and creative stuff. Rossi continues to pile up what is now an even bigger mess for his lawyers to try and clean up.


    Keep it up Rossi! I'm absolutely positive that your "new partners" real (F4) or imaginary (F5), are reading along in what has become a comic strip tragicomedy soap opera. Please keep it coming.

    Argon, who has nothing to do with IH, tried to initiate peace talk with Rossi baed on that info.


    Then comes Rossi's post.


    And now you are confused, and start yet another thread.

    Perhaps, but Rossi's law firm is like an ant compared to the elephant of Jones Day, IH's firm. They are going to be squashed and large sums will be spent by both sides.
