Biaco was a company established on behalf of the founders of ENG8 in early 2020 to be the national operating company in the UK for commercialising the water-cooled EnergiCell technology in the UK. In December 2020 Dr Robert Morgan carried out a successful independent validation of an EnergiCell belonging to ENG8 and the UK company was able to raise investment for developing the UK business.
In January 2021 the directors & officers of Biaco Limited, appointed by the ENG8 founders, decided to "go it alone" and not acquire the IPR from ENG8, instead decided to steal the technology/ IPR and equipment and have been blatantly passing off / misrepresenting the EnergiCell IPR / technology as their own, they even still call it an energy cell.
ENG8 has taken a range of legal actions against Biaco Limited and its directors and officers including; shutting down their public fundraise on the Seedrs platform in 2023, culminating in a high court case in 2023.
High Court cases are expensive, especially so in the intellectual property arena. Biaco's defense budget was larger the budget of ENG8s and ENG8 was not able to keep up with the costs so the Judge ruled in Q2 2024 on a technicality that the case should be struck out due to non payment of fees. costs . Due to legal protocols ENG8 had to appeal. After the appeal against Biaco & officers is heard in Q4 2024 the legal teams advice is to start the litigation afresh once a substantial investment is received in so a new litigation process is fully funded from day one. It does not stop ENG8 developing that water cooled EnergiCell technology or the other EnergiCells.
Intellectual property law in the UK follows the same basis as other forms of property which is " if someone steals your home or car and moves in and makes repairs & upgrades then its still considered the original owners property". ENG8 intends to regain full title to its IPR that is currently in the hands of Biaco.

To me, it sounds like ENG8 couldn’t run a hot bath let alone a Energy company.
I have followed the the whole legal action. Mr Back you should be ashamed of yourself sir, and although the word ashamed is weak, I should perhaps congratule you on the flip side, on how you managed to get investment despite on your « alleged » fraudulent history. The reason for my approach is that i know of people who have invested in you…any nothing solid has materialised, just hot air.
The mind boggles, has the reports turns out are not even yours??? Or can confirm it is?

Just to let you know, LENR-forum is not keen on members using the cloak of anonymity to make personal attacks on people whose details are in the public domain. This is a science led forum, and if you care to make scientific arguments on this or any other relevant technology they would almost certainly be welcomed

Biaco comes across as quite legit, both scientifically and business wise. I don't feel the same towards the competitor they are battling in court. Some here with insider information have quietly expressed a desire to weigh in on the legal issues. Would love for them to come forward and say what they may.

I would say that the forum is not the place for writing about the court dispute, at the moment, or the particular claims, because it could lead to serious trouble - particularly for forum volunteers who live in the UK - as well as those people posting (wherever they are). Although this is a civil case, and not a criminal one, the rules of sub judice still apply. The rules here do differ from those in the US - but as this forum is visible in the UK, it means that non-UK comments can still break the law.
The sub judice rule and contempt of courtwww.pinsentmasons.comIt is fine to report published decisions (or ongoing factual proceedings) by the court, but anyone making outside accusations, in either direction, could face severe penalties.
This thread might have already crossed the line - but it would need someone with legal training to determine if the rules have been seriously breached. We may be OK if simply discussing published technical information - but not the actual dispute.
