Industrial Heat Files Motion to Dismiss Rossi Lawsuit

  • Monty - coin-flipping odds are much better than anything we're seeing in the LENR sector right now. Some times braves souls with resources have to step up and make the bet if anyone expects anything to happen in our life times. Everyone else has been sitting around with their hands in their pockets for the last several years and it was time to step up and stir the pond.

  • Vaporware is a bisiness strategy used in the commercial competition between companies. Is it lying? Is exaggeration of your capabilities lying? Is producing exaggerated expectations about your product in the minds of potential users a lie. Is keeping quite about the limitation of your product a lie?

  • Quizz - thank you for your curiosity. You know that I am not going to be able to share any details with you regarding how IH is investing in LENR R&D. Rossi insisted on using his own agreement as the draft of the IH Leonardo agreement and was not open to…

    Dewey,
Thank you for your candid response.

Regarding the SSM switch and the Lugano report, this is mentioned in the report on p. 7, see the following quote:

"We also chose not to induce the ON/OFF power input mode used in the March 2013 test, despite the fact that we had been informed that the reactor was capable of operating under such conditions for as long a time as necessary. That power input mode, however, would have caused significant temperature increases during the brief intervals of time in which power was fed to the reactor. Moreover, the emissivity of alumina is temperature-dependent: this would have made all calculations troublesome and rendered analysis of the acquired data difficult."

  • Monty and Axil - you both stick with your trajectory for effecting change and I'll stick with mine. Also, please note that it has always been much easier to be a teardown artist than to be a net positive contributor who acquires assets, takes the risk and puts resources to work in hopes of being a change agent for the better. Who you align with also impacts your effectiveness. How you spend your time and treasure determines your impact on humanity. Please choose wisely and do your best to be a net positive contributor.

For the past 20 years, trouble has followed Rossi everywhere he goes. It's his pattern, his history, his M.O. A greedy heart of stone and poison root can always be changed for the better though so I don't lose hope for him in that regard. I've seen that happen before. Perhaps another dose of reality or two will be helpful in that regard.

  • Okay Rends - I see that you've read the same circle logic handbook as the others and that further engagement with you will be fruitless. Here's one for the road - Rossi is a licensor who has $10M of IH money for a PAID-UP E-Cat license.

  • Monty and Axil - you both stick with your trajectory for effecting change and I'll stick with mine.

As a potent backer of LENR, you need to understand what advances LENR and what holds it back. You should use your influence to encourage positive behavior and discourage ineffective behavior.

I point out the faults in the way IH does business to improve their approach to LENR. IMHO, the top priority in LENR is to put out a commercial product onto the market. IH is so incompetent in this direction that there is a major shakeup required in IH technical and project management. As an investor in IH, you should understand how successful product development in done. Job 1 is to hire people who know what they are doing. Get a good and highly experienced personnel manager as a first step to bring in those good people into IH.

  • Abd - did not see your wiki link....but you ment this possibly

Yes, I linked to that, somewhere. Smart, too. And -- hah! She's young, I'm 72.

I wrote that mentioning this was "politically incorrect," because it really has nothing to do with her competence. That is established as likely by other considerations.

  • Also IH - get a better patent lawyer. Copying an experimental report and sending it to the patent office won't get you anywhere.

I suggest you look at Rossi's failed patents and his accepted patent. There are good reasons why his accepted patent is the way it is. He got good advice and years of struggling with the patent office.

You need to be crafty to get an LENR patent approved in the US.

  • Axil - I appreciate your point but let's back up to the starting point. Before you can get into engineering for productization / commercialization, you need to characterize and verify a working a reactor at a 4 to 6 sigma confidence level. Do you disagree?

  • LC - Rossi fought hard for his patent at the USPTO including requesting a meeting in Crystal City where he succeeded in convincing the examiner that he has a deployed working device. That remains quite admirable and he is to be commended for that effort and accomplishment. The depth and value of the issued patent is another matter that has yet to be determined. So far it appears that he has managed to carve out an isthmus that is wide enough to stand on but may be located on the equivalent of a shifty sandbar in a Mississippi river bend.

Before IH characterizes and verifies a working reactor at a 4 to 6 sigma confidence level, IH needs to formulate their own product development, testing, and production methods. You have allowed Rossi to dictate to IH his methods which are good for a one man show, but not for a company that has many other potential products to develop and field. You cannot allow each of those inventors to use his own methods. That is a road to chaos and failure. IH needs to establish a best in class produce development methodology. All the product developers in the IH stable should buy into the IH way, willingly to commit to it wholeheartedly, and acknowledge that it is the best process that they have ever seen.

Did Rossi buy into the IH these ways and means? Do they exist? It does not look like it. Where is the discipline to keep all the IH assets in line?

Does NASA allow each engineer to do what they want, or is their iron clad methodology that NASA imposes on the people who work on any given project to get to the common goal.

Standards and procedures are the answer. That is what system's integrators do.

    Quote

(CNN) -- NASA lost a $125 million Mars orbiter because a Lockheed Martin engineering team used English units of measurement while the agency's team used the more conventional metric system for a key spacecraft operation, according to a review finding released Thursday.

When you allow people to do what they want without management, disaster results.

  • Also, please note that it has always been much easier to be a teardown artist than to be a net positive contributor who acquires assets, takes the risk and puts resources to work in hopes of being a change agent for the better.

Yes Dewey. I can see it now in front of my inner eye. You are the white knight and the brave soul who stands up to be a change agent for the better and helps humanity to a golden age all just for a mere pittance and the good feeling of being a samaritan.
It's a beautiful world I see there. Cats love dogs, politicians are not corrupt and the sun comes up in the west...

  • Axil - This is very interesting and telling. How do you formulate engineering, product development and production methods if you don't know where to start? The product verticals, paths to market, license or branding options, raw material cost, production cost, service and maintenance, 3rd world plan, etc..... You're completely wasting time and money if you're productizing before you know if you have a working reactor and then HOW it works, how long it works, safety, compliance, etc..etc..... Once you have a verified working reactor and understand its characteristics then you can start on your product and market fit. optimization path and beyond. Now if will help you feel a little better, IH has spent a lot of time with some very smart people studying the possibilities for deployment, monetization, scale, speed-to-ubiquity and beyond once a working reaction is in hand but that remains a digital exercise until we get to higher confidence levels regarding LENR reactions.

Rossi has decades of disaster and deception for his track record as a result of his management style and is in trouble again.

Lastly, there is very little rigor in LENR replication these days and if the sector is going to move forward then someone has to bring substantial resources and grown-ups to the party. Anyone else doing that beyond IH right now? The money that Rossi is sucking out of the sector with his lawsuit should also be considered. That is going to cost IH millions to put to bed should the lawsuit continue (don't read settlement - this wrong is going to be made right). That will cut LENR research dollar availability for others and is an issue that should be considered by the Rossi worship crowd.
